The Closing Process: Affordable Housing Lawyer
Purchasing real estate, of any type, requires that the buyer sign several documents, at least some of which are binding legal contracts. We believe that all buyers should retain a competent attorney, experienced with affordable housing transactions, as early on in the process as possible. What you sign today, may bind you later.
Buyer's attorneys review the important documentation, including such things as the restrictive covenants which make the unit "affordable" and which govern and control the use and resale aspects of the unit; the condominium documents; and the Offer Form and the Purchase and Sales Agreement. They also review any title matters and problems and may be involved in the negotiation of the agreements. Buyer's attorneys also provide in depth explanations of the documents presented to buyers to sign at closing. If necessary, the Buyer's attorney may be called on to work with the city and/or state agencies, the brokers and the closing attorney to ensure that the Buyer is protected and that the closing goes smoothly. The bank's attorney represents the interests of the bank and is not duty-bound to protect the Buyer's interests.
